Everlove Festival Participant Waiver and Release of Liability

Location: Osler Bluff Ski Club, The Blue Mountains, ON
Organizer: Everlove Inc., operating as Everlove Festival (referred to as "the Organizers")

1. Assumption of Risk

I understand that participating in the Everlove Festival, which may include activities like yoga, fitness classes, workshops, and other wellness-related experiences, involves risks. These may include but are not limited to physical injury, emotional distress, property damage, and, in rare cases, serious injury or death. I acknowledge that my participation is voluntary and that I am responsible for assessing my own fitness and readiness to engage in these activities. I acknowledge that I have not been advised by a doctor or any medical professional not to engage in such physical activities. I further acknowledge that I assume all associated risks, whether arising from the conditions, equipment, or other participants.

2. Release of Liability

In consideration of being allowed to participate in the Everlove Festival, I, for myself, my heirs, and anyone entitled to act on my behalf, hereby waive, release, and hold harmless Everlove Inc. and its affiliates, including but not limited to its organizers, employees, volunteers, and agents, from any and all claims for damages due to injury, death, property damage, or any other losses arising out of or connected with my participation in the Festival, regardless of whether such damages result from negligence.

3. Medical Consent and Authorization

I consent to receive medical treatment deemed necessary by the Organizers should an injury, accident, or illness occur during my participation. I agree that I am financially responsible for any medical treatment provided, whether such treatment is covered by my insurance or not. I further agree to indemnify and hold the Organizers harmless from any costs or liabilities arising from such treatment.

4. Alcohol and Substance Use

I agree that I shall not consume any alcohol or substances prior to or during the Festival and I acknowledge the risks associated with the use of alcohol or drugs before, during, or after the Festival. I assume full responsibility for any injury, loss, or damage caused by my own alcohol or drug use.

5. Photo and Media Release

I grant Everlove Inc. and its representatives the right to capture my image, likeness, and voice through photographs, video, or other media during the Festival. I consent to these images and recordings being used in any promotional, media or online social content for the Festival without compensation.

6. Code of Conduct

I agree to conduct myself in a respectful manner, follow all instructions provided by the Festival staff, and abide by the Festival’s rules. I acknowledge that any behavior deemed disruptive, dangerous, or disrespectful, in the sole discretion of the Festival staff, may result in my immediate removal from the event without refund.

7. Cancellation and Weather Policy

I acknowledge that the Everlove Festival may be subject to weather conditions or other events beyond the control of the Organizers. In the event of cancellation, delay, or modification, I understand that no refunds will be issued. Should public health regulations or safety concerns necessitate changes, the Organizers reserve the right to adjust or cancel the event accordingly.

8. Indemnification

I agree to indemnify and hold the Organizers harmless from any claims, damages, or expenses that may arise from my participation in the Festival, including legal fees and litigation costs.

9. Governing Law

This waiver shall be governed by the laws of Ontario. Any disputes arising from this waiver or my participation in the Festival shall be resolved in the courts of Collingwood, Ontario.

10. Acknowledgment of Understanding

I have read this Waiver and Release of Liability in its entirety. By signing below, I confirm that I fully understand and voluntarily agree to its terms.
